Welcome to svipon.com. The svipon.com website and its associated services (the "Site" or "Service") are operated by Svipon Inc. ("Svipon", "we", "us", or "our"). The Service is an online educational platform that allows users to create, search, share, and study virtual flashcards organized into stacks.
By accessing or using the Service, you agree to be bound by these Terms of Use (the "Terms"). If you do not agree to all of these Terms, do not use the Service.
Your use of svipon.com is subject to Svipon's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account.
Age Restriction: You must be at least 13 years old to create an account and submit personal information to the Service. By creating an account, you represent and warrant that you are 13 years of age or older.
Use by Children Under 13: Svipon hosts educational content, such as basic math or shape recognition, that is suitable for young audiences. However, children under the age of 13 are strictly prohibited from creating their own accounts. Parents, legal guardians, or educators may create an account and use the Service to share educational flashcards with children under their direct, active supervision. In these instances, the adult account holder is the sole user of the Service, assumes full responsibility for all activities occurring under the account, and is responsible for determining what content is appropriate for the minor.
If we obtain actual knowledge that a user is under 13 years old and has created an account without parental consent, we will promptly delete the account and all associated personal data.
Svipon's Property: The Service, including its original content, features, functionality, card styling, visual design, UI layouts, and templates, are owned by Svipon and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not modify, reverse engineer, or create derivative works of the Svipon platform itself.
User-Generated Content: You retain all ownership rights to the content, text, and images you upload, post, or create within your flashcard stacks ("User Content").
License to Svipon: By creating, uploading, or sharing User Content on the Service, you grant Svipon a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform that User Content in connection with the Service. This includes the right to display your public stacks to other users, format your content for different devices, and use your content for the promotion of the Service.
You agree to use the Service only for lawful, educational purposes. You are strictly prohibited from uploading, sharing, or creating content that:
Svipon has no obligation to monitor User Content but reserves the right to review, remove, or modify any content at any time, without notice, in its sole discretion.
Svipon offers premium subscription plans that provide additional features.
Billing: By enrolling in a subscription, you authorize Svipon to charge your chosen payment method on a recurring basis (e.g., monthly or annually) until you cancel.
Refunds: All payments are non-refundable. If you cancel your subscription, you will not receive a prorated refund for the remainder of your current billing cycle, but you will retain access to your premium features until the end of that cycle.
Advertising: Free tiers of the Service may be supported by advertising. By using the free tier, you agree to the display of such advertisements.
Svipon respects the intellectual property rights of others. If you believe that your copyrighted work has been copied or used on the Service in a way that constitutes copyright infringement, please provide our Copyright Agent with a written notice containing the following information:

Svipon reserves the right, in its sole discretion, to terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason whatsoever, including without limitation a breach of these Terms.
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SVIPON INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SVIPON INC. SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.
In the event the parties are not able to resolve any dispute arising out of or concerning these Terms, such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction.
Any arbitration under these Terms will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/OR REPRESENTATIVE PROCEEDING.
To the maximum extent permitted by law, this agreement is governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
Svipon reserves the right, in its sole discretion, to change the Terms under which the Service is offered. The most current version of the Terms will supersede all previous versions.
